In a letter to “Criminal Justice Partners,” Forensic Science Division Director Jeffrey NYE said the department’s new method platform, Liquid Chromatography with tandem mass spectrometry, “is a significant upgrade” from the prior gas chromatography mass spectrometry method used.

Nye wrote that three independent experts have “confirmed the validation” adheres to testing standards.

To prevent a backlog of samples during the time testing was halted, the department outsourced about 700 samples to an accredited private lab. Of the 238 samples returned, the private labs reported only two instances in which there was a finding of CBD with no THC, Nye’s letter noted.

“Those two instances included the case that initiated the inquiry and a case that staff members identified which also contained a high blood alcohol content,” Nye wrote.
