Legislation is pending, House Bill 6474, which seeks to prohibit municipalities from adopting or enforcing certain ordinances surrounding medical cannabis programs. Specifically, it prohibits a municipality from getting involved in a primary caregiver or qualifying patient’s decision to engage in the use of medicinal marijuana, and disallows either of these parties from following any guidelines other than those outlined in the Michigan Medical Marihuana Act.
Currently under state law, none of these provisions exist to protect the rights of patients and caregivers from any overly burdensome regulations that municipalities may attempt to enact in addition to the state’s existing regulation.
