Developers hoping to operate a marijuana dispensary in the former Hamilton Home Bakery in Saginaw were denied a waiver necessary to dodge a zoning hurdle.

The Saginaw City Council at its Monday, Jan. 23, meeting failed to approve a waiver needed to allow Premier Provisioning ownership to develop a marijuana retail shop inside the old bakery at 1030 Gratiot.

The waiver would have been the first step in providing an exemption from a Saginaw zoning ordinance that forbids marijuana retail shops from standing 250 feet or closer to public parks, officials said. The old bakery sits 208 feet away from Fordney Park.

A majority vote from the council was necessary for the waiver. The council vote was 4-4.

If the council had approved the measure, the dispensary’s ownership also would have needed permission from the Saginaw Zoning Board of Appeals before beginning the development, officials said.
