Viridis Labs and Viridis North cannot revive previously dismissed civil claims against the state’s Cannabis Regulatory Authority for a 2021 recall.
Judge James Robert Redford held Viridis North and Viridis Laboratories’ 2023 request to proceed with damages against the CRA under Bauserman v. Unemployment Insurance Agency based on alleged new assertions was made more than one year following the court’s final order dismissing its lawsuit. Such a delay, he noted, is “not reasonable.”
“Therefore, relief is not available” under the court rules, Redford’s Jan. 2 order reads. “Regardless, plaintiffs have not identified any evidence that justifies reopening this case 19 months following the final order and approximately 14 months after plaintiffs agreed to dismiss their appeal.”
A late message seeking comment from Viridis was not returned today.
CRA spokesperson David HARNS said, “As always, we respect the rulings of the judiciary as we continue to perform our regulatory duties.”
Meanwhile, the CRA and Viridis are before an administrative law judge, who is hearing testimony on whether the lab falsified its potency data. The ALJ has scheduled hearing dates stretching into March.
