Ohio Law Increases Penalty For Selling Cannabis To Those Under 21

Apr 30, 2026 | Dispensaries, Great Lakes Region

Ohio’s new cannabis law adds criminal punishments for giving marijuana to anyone under the age of 21. Senate Bill 56, a new Ohio law with sweeping changes to cannabis use, adjusted the law to create harsher punishments for distributing cannabis to someone underage. Now, knowingly giving an underage person cannabis can be a felony.

The law extends so anyone who knowingly sells or distributes cannabis to someone under 21 is guilty of a first degree misdemeanor. If someone has repeat offenses, the charge becomes a fifth degree felony.
