Legislation Restricting Hemp Moves Closer To Law—May Make These CBD Products Illegal

In November 2026, new legislation is set to take effect that will change the definition of hemp and make popular CBD products currently on the market illegal on the federal level.  

On April 30, a law that could have contained provisions to stop or delay the new rules moved through the U.S. House of Representatives, making the reality of a disrupted CBD market one step closer to reality.

Hemp is currently defined as being any part of the cannabis sativa plant that contains no more than 0.3% delta-9 tetrahydrocannabinol (THC) by dry weight. (THC is the mind-altering substance that can cause a “high” feeling.) Since 2018 and the signing of The Agriculture Improvement Act of 2018—also called the Farm Bill—CBD products have been effectively legalized as long as they come from hemp.
