Michigan Limits How Courts Can Prohibit Marijuana Use For Probationers

In a Monday ruling, the Michigan Supreme Court unanimously held that trial courts can’t ban “legal marijuana use” as a probation condition, based solely on federal law.

Justice Elizabeth Welch wrote in the 17-page opinion issued by the court that because the Supreme Court decided Michigan’s medical marijuana laws preempt a federal ban, so must Michigan’s recreational marijuana law.
