The Nebraska Supreme Court last week upheld the state’s legalization of medical marijuana, ruling that a lower court acted properly when it dismissed a lawsuit from a cannabis prohibitionist. The decision marks the second time this month that Nebraska’s highest court has affirmed the legalization of medical cannabis at the ballot box two years ago.
Nebraska’s voters overwhelmingly approved the legalization of medical cannabis with the passage of Initiative 437 and 438 in 2024, which received 71% and 67% of the vote, respectively.
On Friday, the Nebraska Supreme Court unanimously affirmed a lower court ruling that former state. Sen. John Kuehn lacked legal standing to challenge the state’s legalization of medical cannabis.
