The Cannabis Regulatory Agency (CRA) is reminding licensees of the requirement that all marijuana products (including flower) which fail testing for Aspergillus must subsequently be tested for mycotoxins.

Rule 420.306(3), promulgated on March 7, 2022, states “products that failed testing for Aspergillus may be remediated after subsequent testing for mycotoxins in accordance with R 420.305(3)(h).”

Testing for mycotoxins on a product which has failed for Aspergillus should be conducted prior to submitting a request for remediation to the CRA. CRA staff will ensure that mycotoxin testing is performed prior to approving remediation requests and licensees’ remediation requests will be denied if this test has not been completed.

As is customary with newly implemented testing requirements, the CRA is allowing licensees time to be educated on the requirements and come into compliance prior to enforcement, which will begin on December 1, 2022.
