Lawsuit To Stop 24 Percent Wholesale Cannabis Tax From Taking Effect Jan. 1 Scheduled To Be Heard Nov. 25 In Detroit

The Michigan Cannabis Industry Association, representing hundreds of Michigan cannabis companies, will make oral arguments next week to try and stop the Michigan Treasury from assessing a 24 percent wholesale tax on cannabis sales. The MiCIA is asking for a preliminary injunction. The tax is scheduled to be collected Jan. 1, 2026.

The MiCIA joins legal proceedings brought against the State of Michigan and Michigan Treasury Department by the Holistic Research Group, a licensed cultivator and processor located in Harrison Township, filed a similar lawsuit and is seeking a preliminary injunction to block implementation of the tax while the legal case plays out.

Both lawsuits were consolidated into one.

Oral arguments have been scheduled for the motion for preliminary injunction on Tuesday, November 25th at 11AM at the Michigan Court of Appeals in Detroit.
